Probation Violation

Have you violated your probation? You can receive up to the maximum sentence set at your original sentencing if the prosecutor convinces the judge you have violated your probation.  That is why it is essential to hire an experienced Orlando criminal attorney.

There are 7 types of supervision or “probation” that can be ordered by the court. The Department of Corrections administers the following:

  • Community Control

Any of these types of supervision are referred to as “probation”. 

There are two types of probation violations. One is a substantive violation where there is the accusation of a new crime. The other is a technical violation. Some examples of technical violation are:

  • Changing address and not notifying your supervising officer
  • Committing an illegal behavior
  • Excessive use of intoxicants
  • Not filing a monthly report

When a new criminal offense is charged against you then you experience a substantive violation of probation. 


You should never admit to a violation of your probation.  There are defenses that can be used often times.  If you admit to the violation, the use of these defenses will be eliminated.
Always remember to report to your supervising officer as scheduled no matter what.  Be truthful when completing your monthly report and report if you have been arrested.  If you lie on your report you can be found in violation of your probation.
